1. Acceptance of Terms

By creating an account, downloading the app, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Trash Talk Inc.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Trash Talk is an AI-powered sports trash talk generation platform. The Service uses artificial intelligence to analyze live game data, scores, player statistics, and real-time sports events to generate personalized trash talk messages that users can share with friends.

Key features of the Service include:

• AI-generated trash talk based on real-time sports scores and statistics
• Multi-sport coverage including NFL, NBA, MLB, and NHL
• Friend management with team assignments for personalized content
• Adjustable tone settings from mild to savage
• One-tap sharing to messaging platforms
• Push notifications when friends' teams lose or underperform

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. User Accounts

Age Requirement: You must be at least 13 years of age to create an account and use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Account Security: You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. Trash Talk Inc. will not be liable for any loss or damage arising from your failure to protect your account information.

Account Accuracy: You agree to provide accurate, current, and complete information when creating your account and to update your information as necessary to keep it accurate and complete.

4. Acceptable Use

Trash Talk is designed for fun, light-hearted sports banter between friends. While we encourage competitive ribbing, you agree to the following rules when using the Service:

• Sports-performance-only trash talk. Content generated and shared through the Service should relate to sports performance, game outcomes, player statistics, and team results.
• No harassment beyond sports banter. Do not use the Service to target individuals with personal attacks unrelated to sports. Keep it about the game.
• No hate speech. Content that promotes hatred, discrimination, or violence based on race, ethnicity, gender, religion, sexual orientation, disability, or any other protected characteristic is strictly prohibited.
• No threats. Do not use the Service to make threats of violence, harm, or intimidation against any person, whether in earnest or presented as humor.
• No illegal activity. Do not use the Service for any purpose that violates applicable local, state, national, or international law.
• No spam or abuse. Do not use the Service to send unsolicited bulk messages or to harass individuals who have asked you to stop.

We reserve the right to review content and usage patterns, and to take action, including account suspension or termination, against users who violate these guidelines.

5. AI-Generated Content

Nature of Content: The trash talk messages provided by the Service are generated by artificial intelligence. While we use live game data to produce relevant and timely content, AI-generated messages may not always be perfectly accurate, complete, or up to date.

No Guarantee of Accuracy: We do not guarantee that any AI-generated content will be factually correct, free from errors, or appropriate for all audiences. Game scores, player statistics, and other data referenced in generated messages may occasionally contain inaccuracies.

User Responsibility: You are solely responsible for reviewing any AI-generated content before choosing to share it. Once you send a message to another person, you assume full responsibility for that communication. Trash Talk Inc. is not liable for any consequences resulting from messages you choose to send.

Content Moderation: We implement filters and moderation systems to prevent the generation of harmful or inappropriate content. However, no system is perfect, and we encourage users to report any content they find objectionable.

6. Intellectual Property

Our Property: The Service, including its design, features, code, algorithms, branding, logos, and all associated intellectual property, is owned by Trash Talk Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

Your Content: You retain ownership of the messages you choose to send through external messaging platforms. By using the Service, you grant Trash Talk Inc. a non-exclusive, royalty-free license to use anonymized and aggregated usage data to improve the Service.

Feedback: If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use that feedback without restriction or compensation.

7. Subscription & Payments

Free Tier: Trash Talk offers a free tier with limited features, including a capped number of AI-generated messages per day and access to basic tone settings.

Premium Subscription: A premium subscription unlocks additional features, including unlimited message generation, advanced tone options, priority notifications, and more. Premium subscription details, pricing, and features are described within the app and may change from time to time.

Auto-Renewal: Premium subscriptions automatically renew at the end of each billing cycle (monthly or annual, depending on your plan) unless you cancel before the renewal date. You will be charged through your selected payment method at the then-current subscription rate.

Cancellation: You may cancel your premium subscription at any time through your account settings or through your app store account (Apple App Store or Google Play Store). Cancellation takes effect at the end of the current billing period, and you will continue to have access to premium features until that time. Refunds are not provided for partial billing periods.

Price Changes: We may change subscription pricing at any time. If we increase prices, we will provide reasonable advance notice, and the new price will take effect at the start of your next billing cycle.

8. Termination

We reserve the right to suspend or terminate your account and access to the Service, without prior notice, if we reasonably believe that you have violated these Terms. Grounds for termination include, but are not limited to:

• Violating the Acceptable Use policy outlined in Section 4
• Engaging in fraudulent activity or misrepresenting your identity
• Attempting to disrupt, compromise, or reverse-engineer the Service
• Using the Service in a way that could harm Trash Talk Inc. or other users

You may also delete your account at any time through the app settings. Upon termination or deletion, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Trash Talk Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service.

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall our total liability to you for all claims related to the Service exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Changes to Terms

We may update these Terms from time to time to reflect changes to the Service, legal requirements, or business practices. When we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last Updated" date above.

We may also provide additional notice for significant changes, such as an in-app notification or an email to the address associated with your account. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
